Entered into by and between Vertice Home Inspections and the Client.
This Agreement governs the inspection services requested by the client and sets forth the complete understanding between the parties regarding the scope of the inspection, the limitations of the services provided, the responsibilities of each party, and the legal terms applicable to the inspection and the resulting inspection report.
By electronically signing this Agreement, the client confirms that they have carefully read, fully understood, and voluntarily accepted every provision contained herein.
No inspection services shall be performed until this Agreement has been executed electronically and payment has been received in accordance with the Company's payment policy.
PURPOSE OF THE INSPECTION
The purpose of the inspection is to provide the Client with a professional visual assessment of the observable condition of the property at the time and date of the inspection.
The inspection is intended to assist the Client in making an informed real estate decision. It is not intended to eliminate all risks associated with purchasing, selling, owning, or occupying the property.
The inspection represents the professional opinion of the Inspector based solely upon the visible and readily accessible conditions existing at the time of the inspection.
Because buildings, building systems, mechanical equipment, structural components, and environmental conditions continually change, no inspection can predict future performance, future failures, hidden defects, concealed conditions, or conditions that become apparent after the inspection has been completed.
DEFINITIONS
For purposes of this Agreement, the following definitions shall apply:
"Inspection" means a limited, non-invasive, visual examination of the readily accessible systems and components of the property.
"Inspector" means Vértice Home Inspections and any employee, contractor, licensed inspector, trainee, consultant, representative, or authorized agent acting on behalf of the Company.
"Client" means the person(s), corporation(s), partnership(s), trust(s), legal representative(s), purchaser(s), seller(s), owner(s), real estate brokerage, or any party who contracts for the inspection services.
"Property" means the land, dwelling, structures, improvements, garages, accessory buildings, and components located at the inspection address.
"Inspection Report" means the written report, digital report, photographs, videos, thermal images, drone images, notes, recommendations, summaries, diagrams, and any supplemental documents prepared by Vértice Home Inspections.
"Accessible" means capable of being safely observed without moving furniture, personal belongings, floor coverings, insulation, stored items, equipment, finishes, or performing any destructive procedure.
"Visible" means plainly observable without dismantling, damaging, disassembling, removing, or altering any component.
"Defect" means a condition that, in the professional judgment of the Inspector at the time of inspection, has a significant adverse impact on the value of the property, poses an unreasonable risk to people, or requires major repair or replacement.
"Material Defect" means a defect that substantially affects the function, safety, habitability, or structural integrity of a readily accessible component.
"Latent Defect" means any hidden, concealed, underground, intermittent, inaccessible, or otherwise undiscoverable defect that cannot be identified through a visual inspection.
"Representative" includes any family member, attorney, contractor, consultant, engineer, insurance company, real estate professional, lender, tenant, occupant, or any other individual acting on behalf of the Client.
